E-Signature Laws

RightSignature's technology meets and exceeds standards established by the primary e-signature laws:

  • 2000 U.S. Electronic Signatures in Global and National Commerce Act (ESIGN)
  • Uniform Electronic Transactions Act (UETA)
  • European Directive (EC/1999/93)

All of these laws intended to encourage the rapid adoption of electronic signatures and decrease use of antiquated paper methods. Each of these acts reinforces the validity of electronic agreements. According to ESIGN, for example, a contract "may not be denied legal effect, validity, or enforceability solely because an electronic signature or electronic record was used in its formation."


Intent to Sign
One of the primary criteria for a valid e-signature is a clear intent to sign. RightSignature's capture of a real handwritten signature provides a conclusive indication of the signer's intent to execute the document. Furthermore, RightSignature's second-generation handwritten signature capture technology overcomes the potential vulnerabilities of first-generation click-to-sign systems, where intent may be harder to prove.


Signature Associated with Document
An e-signature must be electronically associated with a document, or a graphical representation must be apparent on the signed record. Court-Admissible Audit Log

Authentication
RightSignature employs a proprietary, multivariate identity authentication system. Components include email address validation, biometric signature analysis, IP address capture, and the collection of other identifiers unique to each signing party.
